Contestants on a new reality show share their deepest, darkest secrets in an attempt to win cash, but what happens when the secrets they reveal are fireable offenses? In "The Moment of Truth" participants are asked 21 personal questions while hooked to a lie detector. They can win up to $500,000, but lose if they get caught in a lie. Barbara Roth, a partner at the law firm Hogan & Hartson, said, "It would be neither illegal nor unfair for an employer to act on information that is lawfully considered about an employee in making an employment decision." But, employers are highly unlikely to act, according to Matt Gilligan, a partner at Alston & Bird in Atlanta, because of laws like the Employee Polygraph Protection Act, which prevents employers from using lie detectors at work. "Lawyers representing employees are always seeking legal theories to attack outrageous unfair terminations for off-duty behavior or off-duty revelations of private matters unrelated to job performance," said Paul Tobias, a senior partner at Cincinnati-based Tobias, Kraus & Torchia, a law firm that specializes in wrongful termination suits.
